Why do they post encounter levels above the encounters, sorry for the blunt question, but in a pre-set adventure, what does it matter. Like in the Sylvan Key, first you have EL1 with the Kender and then EL3 with the Herald, what's the reasons?

To make the job easier for you, you know how difficult the encounter is gonna be and how much expirience to give.

but isn't experience figure out by the CR, how do you take the EL from that chart and put it on the CR chart,
Don't the encountered creatures/humans have CR numbers anyway

Nopers. EL is Encounter Level, and that is what Experience is based off of. CR is Challenge Rating. Each individual creature has one CR, but a total encounter has an EL.

For example, if you fought two CR 8 creatures, it would be an EL 10, and the experience would be determined as such. One CR 8 creature is just an EL 8, and so the experience can be determined that way as well.

All in all, CRs, ELs, and such can be confusing, but getting the basics down should help. The reason they include the ELs in the book is just to make it easier for determining Experience.

But when looking in the DMG, I get the XP from the CR table on page 38, how do I get XP form the EL table on page 49?

Don't I look on the EL table to get the CR and then look on the CR table to get the XP?

Perhaps you should try asking this particular question on the Dungeon Master's forum, as it's not specifically about Dragonlance but about calculating XP??

Try posting your question here http://boards1.wizards.com/forumdisplay.php?s=&forumid=22 as this area is full of DM's from ALL campaign worlds.
